Who controls your data
The data controller is The Nursery Business Limited, registered in England and Wales, company number 15355905, registered office Victoria House, 26 Queen Victoria Street, Reading, Berkshire, United Kingdom, RG1 1TG, trading as The Nursery Business. The data we collect
When you use the contact form or request a tool result, we collect the contact details and business information you choose to provide. Tool submissions may also include the result or summary generated by the tool, such as a Nursery Business Checker score, Fee Increase Calculator result, Enquiry Leak Checker result or the headline outputs you choose to send from the Nursery Profitability Checker or 13-Week Cash Flow Planner. We also receive information you choose to send by email or provide during a call.
The Retention Working Pack asks for your name, nursery or group and email before revealing the printable pack. If you register interest in the EYFS Inspection Playbook, we collect your name and email, plus any optional nursery/group name and number of settings you choose to provide. For gated tools, detailed financial, staffing and checklist inputs remain in your browser unless the page clearly says otherwise. The contact details and headline result shown at the result gate are sent to TNB when you unlock the result.
Why we collect it and our lawful basis
We use this information to provide the result or resource you requested, respond to your enquiry, decide whether and how we can help, arrange a call, prepare a proposal and keep an appropriate record of the conversation. Our lawful basis for these activities is generally legitimate interests in responding to prospective clients and operating the consultancy, or taking steps at your request before entering into a contract where applicable. If you register interest in the EYFS Inspection Playbook, we rely on your consent to email you about that launch and related Playbook updates. If you separately tick a Weekly Brief or checker follow-up opt-in box, we rely on that consent for those marketing emails and record when and where the consent was given. You can unsubscribe or withdraw that consent at any time. Access to a requested tool, result, report or sample is not conditional on agreeing to marketing emails. Marketing or follow-up email choices are optional and separate from the information needed to provide the requested service. If you choose to enable Google Analytics 4, we rely on your consent for the optional analytics storage and associated analytics processing. You can reject it or withdraw that choice at any time through Cookie settings without affecting access to the site.
How long we keep it
Enquiry information is kept for 24 months from our last contact with you, unless a longer period is required by law or the enquiry becomes a client engagement governed by separate retention requirements. We then delete or securely anonymise it.
Who we share it with
We do not sell your personal data or pass it to another nursery. Website forms are captured through Netlify Forms, which processes submissions on our behalf. The gated checkers use the same Netlify Forms capture. They ask for your first name, email and nursery or group name, and store the tool name and headline result so the requested result can be provided and recorded. Where you request an emailed resource, register interest in the EYFS Inspection Playbook, or separately opt in to the Weekly Brief or checker follow-up emails, MailerLite may also process your email address and relevant source tags on our behalf. We use Plausible Analytics to measure aggregate page visits, downloads and conversion paths without setting analytics cookies. We also use optional Google Analytics 4 (GA4) when a visitor actively accepts analytics. GA4 helps us understand pages viewed, traffic sources, device/browser information and site interactions. The GA4 tag is blocked until analytics consent is given, and the site keeps Google advertising storage, advertising user data and advertising personalisation denied. We do not intentionally send names, email addresses or form-field contents to GA4. Data may also be handled by essential email, hosting, professional advisory and IT service providers where needed to operate the business.
Setting profile saved in your browser
If you choose to save setting details for the free tools, the information is stored locally in your browser using localStorage. Saving the profile does not send it to The Nursery Business and the saved profile is not automatically attached to ordinary form submissions. Some saved values may be used to pre-fill visible fields in supported tools. If you then choose to submit a form containing one of those visible values, that value is sent as part of the form you can see. The profile can include business information such as registered places, occupancy, rooms and high-level qualification labels. Do not enter DBS information, health information, disciplinary records or other sensitive staff data. You can edit or clear the saved profile from any supported TNB tool.
International transfers
Some technology providers may process data outside the United Kingdom. Where personal data leaves the UK, an appropriate UK GDPR safeguard should apply, such as an adequacy regulation or approved contractual arrangements. You may contact The Nursery Business Limited for information about the safeguard used for a particular provider.
Your rights
Depending on the circumstances, you may have rights to access or correct your personal data, ask for it to be erased, restrict or object to processing, and receive portable data. Where processing is based on consent, you can withdraw that consent. These rights are not absolute. Contact us using the email above to make a request.
Complaints
Please contact us first if you have a concern. You also have the right to complain to the Information Commissioner’s Office. Guidance and contact details are available at ico.org.uk/make-a-complaint.
Changes to this notice
We may update this notice when our services, suppliers or legal obligations change. The date at the top shows when the current version was last updated.
